Semantic Works LLC (“Semantic Works,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we handle information in connection with the My Brain Agent macOS software application (the “App”) and the MyBrainAgent.com website (the “Site”).

By installing the App or using the Site, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Core Privacy Principles: Local Processing

The App is fundamentally designed as a local utility.

• Your Content Stays Local: The App does not collect, store, or transmit your documents, files, extracted text, Google Drive contents, MCP communications, prompts, or generated outputs.
• No Cloud Tracking: We do not track your local user workflows, prompts, source code modifications, or interaction histories with local AI clients or applications. All such processing occurs strictly on your local machine.

2. Information We Collect and How We Use It

While the App operates locally, we do collect limited information under specific circumstances to manage software licensing, provide the Site, and communicate with you.

A. Information Collected via the App (License Verification)

To protect our intellectual property and confirm your authorization to use the software, the App periodically connects to our servers to validate your license.

What is Transmitted: The App transmits the license key or license file information provided to you, together with a cryptographic SHA-256 hash derived from a device-specific identifier. The hash is used solely for license validation and license lease management.

What is NOT Transmitted: The App does not transmit your files, documents, file contents, local file paths, prompts, MCP communications, or other user-generated data.

B. Information You Provide Directly to Us

We collect information that you choose to send directly to us, which may include:

• Support and Communications: If you contact us for technical support, ask a question, or send an email to our legal address, we collect your name, email address, and any information or attachments you include in your message. We use this information solely to respond to your request.
• Transaction and Billing Data: When you purchase a license for the App, your payment is processed by our third-party payment processors. Semantic Works does not store your credit card numbers or full financial credentials. We receive only transaction confirmations and basic order management details (such as your name, email address, purchase amount, and generated license key).

C. Information Collected Automatically on the Site

When you browse the Site, certain standard server-log information may be collected automatically, including your IP address, browser type, operating system, referring URLs, and the dates and times of your visits.

We use Google Analytics, a web analytics service provided by Google LLC ("Google"), to help us understand how visitors interact with our Site.

• How it Works: Google Analytics uses cookies—small text files placed on your computer—to collect standard internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the Site (including your IP address) is transmitted to and stored by Google on servers in the United States.

• How We Use It: We use this compiled statistical data to evaluate Site activity, analyze visitor trends, improve website usability, and optimize our marketing. We do not use Google Analytics to gather personally identifiable information.

• How to Opt Out: You can prevent Google Analytics from collecting information about your visits by disabling cookies in your browser settings, or by installing the official Google Analytics Opt-out Browser Add-on provided by Google.

D. Application Analytics and Diagnostics

The App is designed to operate locally and does not collect usage analytics, telemetry, or behavioral tracking data from your computer.

The App does not transmit:

• files;
• document contents;
• extracted text;
• MCP requests or responses;
• prompts;
• local file paths; or
• information about your local workflows.

If the App collects optional diagnostic information in the future, such collection will be limited to technical information necessary to improve reliability, such as application version, operating system version, crash information, or error logs. Any such collection will be described in an updated version of this Privacy Policy.

3. Third-Party Services and External API Keys

The App serves as an interface that allows you to connect third-party software, local developer tools, or external AI services.

• Optional Third-Party API Keys: The App may allow you to optionally enter your own API keys or developer credentials for third-party services (such as Google Gemini, OpenAI, or other providers). These keys are stored locally on your machine.
• Direct External Connections: When you use these third-party connections, your prompts, commands, or metadata are transmitted directly from your computer to those third-party providers. Their handling of your data is governed strictly by their respective terms and privacy policies.
• Our Responsibility: Semantic Works does not operate, control, or review these external transmissions, and we are not responsible for the privacy, security, or data handling practices of any third-party services you choose to connect.

4. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties. We only share information in the following limited circumstances:

• Service Providers: We may share basic transactional information with trusted third-party vendors who perform services on our behalf, such as payment processing, website hosting, or email delivery. These providers process information according to their own agreements, privacy policies, and applicable legal obligations.
• Legal Compliance: We may disclose your information if we believe in good faith that doing so is required to comply with applicable state, federal, or international laws, valid legal processes (such as a subpoena), or to protect the safety, rights, and property of Semantic Works, our users, or the public.
• Business Transfers: If Semantic Works is involved in a merger, acquisition, asset sale, or corporate restructuring, user information may be transferred as part of the business assets.

We implement reasonable technical, administrative, and physical safeguards designed to protect your limited transaction records and support correspondence against unauthorized access, loss, or alteration. However, please be aware that no transmission of data over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

Neither the App nor the Site is directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe that a child under 13 has provided us with personal information, please contact us immediately, and we will take steps to delete that information from our records.

We may update this Privacy Policy from time to time to reflect changes in our software operations or evolving legal requirements.
